Telangana high court sets aside order directing IPS trainee to undergo potency test

Hyderabad: Telangana high court on Wednesday set aside a lower court order that had directed a trainee IPS officer to undergo a potency test in connection with a rape case registered against him for allegedly sexually assaulting his colleague at SVP National Police Academy, Shivrampally.Justice J Sreenivas Rao passed the order while hearing the probationer challenging the lower court’s order as illegal and arbitrary.Relying on the principles laid down by the Madras and Karnataka high courts in similar cases, the judge said that ā€œthe application filed by the prosecution in this case is not in consonance with the principles laid down in precedent rulingsā€.The judge further made it clear that this order of the high court would not preclude the prosecution from filing an appropriate petition, if necessity arises, in accordance with the law.Meanwhile, another petition filed by the same individual for quashing the case against him is pending before the court.
