Probe sex assault case against Nagina MP Chandrashekhar Azad, court directs Delhi cops

NEW DELHI: A Delhi court has issued a notice to DCP, IGI airport, directing that an inquiry into a sexual assault complaint against Nagina MP Chandrashekhar Azad be completed and the report be filed by the next date of hearing, after rejecting Delhi Police‘s request for more time.The court of additional chief judicial magistrate Neha Mittal listed the matter for further hearing on Oct 23.The complainant has accused Azad of raping her on the pretext of marriage.Alleging that police failed to register an FIR, she had approached the court seeking a direction for registration of a case against Azad.

Police submitted a status report detailing the progress of the inquiry conducted so far. However, they sought an additional two to three months to conclude the preliminary probe. The complainant opposed the police plea for more time.The judge noted in the order that "since the offence alleged in the present application is punishable with life imprisonment, section 173(3) BNSS does not apply and hence, there is no scope for conducting preliminary inquiry".Section 173(3) allows police to conduct a preliminary inquiry before registering an FIR for offences that carry a jail term of three to under seven years.
