TGRERA bars sale of nine flats in Tellapur project after double-sale allegations

Hyderabad: The Telangana Real Estate Regulatory Authority (TGRERA) has restrained a developer from selling, mortgaging or creating third-party rights over nine flats in a residential project at Tellapur in Sangareddy district, citing allegations of double sales involving other units in the same project. In a common interim order dated Oct 29, the authority observed that the developer’s counsel did not deny the earlier double sales but submitted that alternative units would be allotted. It held that the nine complainants’ apprehensions of similar transactions were genuine and warranted protection. The complaints concern flats in Tripuras Green Alpha at Tellapur village in Ramachandrapuram mandal. Buyers alleged that they had paid the entire or a substantial portion of the agreed sale consideration, with receipts acknowledged by the developer. Despite delays beyond the committed timeline, the developer allegedly demanded additional amounts instead of executing sale deeds. The complainants also alleged threats to cancel their allotments and sell the flats to third parties. The protected properties are flats 411, 1006, 608, 502, 811, 210 and 503 in Block A, and flats 404 and 906 in Block E.Following a hearing on Oct 9, TGRERA observed that allowing further sales could trigger fresh litigation and render its eventual orders ineffective. Finding a prima facie case of payment and allotment, it held that the balance of convenience favoured protecting the properties. It also noted that similar interim relief had been granted in other complaints concerning the project on July 21, 2026.Invoking Section 36 of the RERA Act, the authority restrained the developer, its partners, agents and persons claiming through it from transferring or encumbering the nine flats until further orders. Violations could attract action under Section 63 of the Act.The authority clarified that the order was interim and did not constitute a final decision on the complaints. No refund or compensation was awarded. The next hearing was scheduled for Oct 30.
