Hyderabad: Telangana high court on Monday issued notices to BRS MLCs T Madhusudhan and N Naveen Kumar Reddy on a petition filed by Hyderabad police seeking permission to arrest them in a case related to their alleged derogatory remarks against assembly speaker G Prasad Kumar.Justice BR Madhusudhan Rao, hearing the matter, directed the MLCs to file their responses and adjourned the case to Sept 23.
The case stems from an incident near the assembly on Sept 7, in which the two MLCs allegedly made objectionable remarks against the speaker. Police subsequently registered a case and took them into custody. However, a trial court declined to remand them to judicial custody and instead directed their release on personal bonds of ₹20,000 each with sureties.Challenging that order, Hyderabad police approached the high court, contending that the trial court erred in rejecting the remand request. The police argued that failure to arrest and remand the accused, despite allegations of using abusive and vulgar language against a constitutional authority, could send a wrong message and encourage similar conduct.Public prosecutor Palle Nageswar Rao submitted that the magistrate’s decision to release the accused on bonds was contrary to the procedure prescribed under the Bharatiya Nagarik Suraksha Sanhita.He further argued that the magistrate had gone beyond the scope of remand proceedings and recorded findings that were inconsistent with the remand case diary.“Furthermore, the accused being members of the legislative council could not by itself justify the course adopted by the magistrate,” he submitted.Seeking intervention, the prosecution urged the high court to call for the records, set aside the remand rejection order and permit police to arrest the two MLCs and seek their judicial remand in the case.
